4-month-old baby abuse - maid's 20-year jail set aside



KUANTAN: The Kuantan High Court Wednesday set aside the Sessions Court's conviction of the Indonesian maid who pleaded guilty to hurling and abusing her employer's four-month-old baby boy on Feb 15 and ordered a
retrial.

Judge Datuk Seri Mariana Yahya arrived at the decision on the grounds that Yuliana (pic), 23, from Acheh, had not fully understood the charges which were read out to her before the Sessions Court judge.

On March 12, Mariana had ordered the woman to be detained for three months at the Permai Hospital, Johor to determine her state of mind at the time of the incident, after her counsel T. Vijayandran, who was appointed by the Indonesian Embassy, applied for a stay of execution.

Among the reasons Mariana stated to warrant a new trial were that the Sessions Court judge had erred to determine if the appellant had understood the charges against her and that she was unrepresented at the time.

"The 15 and five-year jail terms for the first and second charges were also too heavy, furthermore the judge failed to state the intention behind the appellant's act in the facts of the case," she added.

Yuliana's retrial at the Sessions Court was scheduled for Jan 6, 2014.

Meanwhile, Dino Nur Wahyuddin, a representative of the Indonesian Embassy, who was present at court Wednesday, later told reporters that Yuliana would be housed in a special shelter at the Kuala Lumpur Embassy until the new trial.
